JASAJ General Terms and Conditions

§1 Scope

• 1.1. The following General Terms and Conditions (GTC) apply exclusively to the business relationship between Jasmin Schaal and the purchaser of goods via the online sales platform JASAJ-FASHION.COM.
• 1.2. Goods within the meaning of these GTC are all products and services that can be purchased as part of an online order in the JASAJ online shop.
• 1.3. The following General Terms and Conditions do not apply to orders placed with JASAJ outside the JASAJ online shop.

§2 Conclusion of contract

• 2.1. The presentation of products on www.jasaj-fashion.com does not constitute a legally binding offer, but rather a non-binding online catalog.
• 2.2. By clicking on the order button, you are placing a binding order for the goods contained in your shopping cart.
• 2.3. The automatic confirmation of receipt merely confirms that your order has been received by JASAJ and does not constitute acceptance of your offer.
• 2.4. The purchase contract is only concluded by express declaration or dispatch of the goods.
• 2.5. We work paperless. The invoice, delivery note, and, if applicable, the DHL return label will be sent by email. If you do not receive an automatic order confirmation from us after completing your order, please check your spam folder. When registering, please provide your telephone or cell phone number so that we can contact you if your email cannot be delivered. We only use telephone numbers in case of problems or questions regarding the order and not for advertising purposes.
• 2.6. Your order data will be stored by us in accordance with legal requirements. If you have registered in the JASAJ online shop, you can access your order data under “My Account.”
• 2.7. The contract language and contractual correspondence shall be in German.

§3 Right of withdrawal

If you are an EU consumer, you have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You can inform us by initiating the return process in the shop in the event of withdrawal. You can also inform us by email at info@jasaj-fashion.com or via WhatsApp +491608569069. Please include your full name in all cases.

If you organize the return yourself, you must still inform us in advance. Simply returning the goods is not sufficient (§§ 355 ff., 312 ff. BGB).

To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your revocation of this contract.

Return shipping is not free of charge. We charge €5,20 within Germany and €12,50 from Europe for returns.

We will use the same means of payment for this refund as you used for the original transaction.

We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You shall bear the cost of returning the goods if you did not order them during a promotional period in which we expressly offer free return shipping.

Reasons for exclusion or expiry of the right of withdrawal

The right of withdrawal only applies to items that have not been customized or altered. The right of withdrawal expires for personalized products.

Loss of value

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality. This means that a loss in value of the goods occurs if the goods are no longer saleable due to wearing, washing, or other signs of use, as well as removal of the security label, removal/damage to the original packaging, or missing accessories.

In this case, compensation for the value of the goods will be deducted from the credit note. This can be up to 100% if the goods can no longer be sold. In the case of 100% compensation for loss of value, you can reclaim the purchased items from us.

§4 Retention of title

The goods remain the property of Jasmin Schaal JASAJ-FASHION.COM until they have been paid for in full.

§5 Delivery

• 5.1. JASAJ ships goods exclusively to delivery addresses in Germany and Austria. JASAJ-FASHION.COM bears the transport risk.
• 5.2. The delivery time is up to two business days within Germany and up to five days to Austria from receipt of order, unless a shorter delivery time is specified during the ordering process.

§6 Prices / Shipping costs

• 6.1. The prices at the time of ordering apply.
• 6.2. All prices stated in the JASAJ online shop are end consumer prices and include the statutory value added tax of 19% and do not include shipping costs.
• 6.3. Any service and shipping costs incurred can be found on the help pages. They are also specified in the order form.

§7 Terms of payment / means of payment

• 7.1. You can pay for your order at JASAJ-FASHION.COM by:
• PayPal
• Credit card (via the payment service provider PayPal; however, you do NOT need a PayPal account)
• Advance payment by bank transfer (no invoice or installment payment)
• 7.2. Payment by voucher code is made by entering the voucher code in the field provided during the ordering process and then clicking on the “Apply code” button.
• 7.3. The discount through a promotional code is also applied by entering the code during the ordering process.
• 7.4. Coupon codes are only valid during the promotional period and cannot be combined with other promotions.

§8 Warranty

Jasmin Schaal JASAJ-FASHION.COM is liable for material defects and defects of title in accordance with the applicable statutory provisions, in particular §§ 434 ff. BGB (German Civil Code). The limitation period is two years in accordance with § 438 (1) No. 3 BGB and begins with the delivery of the goods. The above provisions do not restrict your right of withdrawal in accordance with §3.

§10 Choice of law, validity

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in the European Union, the law of the country in which you reside may also apply if it contains mandatory provisions.

§11 Dispute resolution

Online dispute resolution pursuant to Art. 14 (1) ODR Regulation: The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr/. Jasmin Schaal is willing to participate in dispute resolution proceedings before a consumer arbitration board.

§12 Copyright

The content and structure of the JASAJ online shop and other websites and social media portals operated by JASAJ are protected by copyright. All texts, images, graphics, audio, and video are subject to copyright, trademark law, and other laws protecting intellectual property. Use for purposes other than private purposes is not permitted without the prior express written consent of JASAJ.
