General Terms and Conditions JASAJ

§1 Scope

• 1.1. The following General Terms and Conditions (GTC) apply exclusively to the business relationship between Jasmin Schaal and the purchaser of goods via the online sales platform JASAJ-FASHION.COM.
• 1.2. Goods within the meaning of these Terms and Conditions are all products and services that can be purchased as part of an online order in the JASAJ online shop.
• 1.3. The following General Terms and Conditions do not apply to orders placed with JASAJ outside the JASAJ online shop.

§2 Conclusion of contract

• 2.1. The presentation of the products on www.jasaj-fashion.com does not constitute a legally binding offer, but rather a non-binding online catalog.
• 2.2. By clicking the order button, you place a binding order for the goods contained in the shopping cart.
• 2.3. The automatic confirmation of receipt merely confirms that JASAJ has received your order and does not constitute acceptance of your offer.
• 2.4. The purchase contract is only concluded through an express declaration or the dispatch of the goods.
• 2.5. We operate a paperless system. The invoice, delivery note, and, if applicable, the DHL return slip are sent by email. If you don't receive an automatic order confirmation from us after completing your order, please check your spam folder. When registering, please provide your telephone or mobile number so we can contact you if an email is undeliverable. We only use telephone numbers for problems or questions regarding your order and not for marketing purposes.
• 2.6. Your order data will be stored by us in accordance with legal regulations. If you have registered with the JASAJ online shop, you can access your order data under "My Account."
• 2.7. The contractual language and contractual correspondence shall be in German.

§3 Right of withdrawal

If you are a consumer in the EU, you have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods.

You can notify us by initiating the return process in the shop upon cancellation . You can also notify us by email at info@jasaj-fashion.com or via WhatsApp at +491608569069 . Please always include your full name.

If you organize a return yourself, you must still notify us in advance. Simply returning the goods is not sufficient (§§ 355 et seq., 312 et seq. of the German Civil Code).

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.

Returns are not free of charge. We charge €4.99 for returns within Germany and €9.99 for returns within Europe.

For this refund, we will use the same means of payment that you used for the original transaction.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the cost of returning the goods if you did not order them during a promotional period, in which case we expressly offer free return shipping.

Grounds for exclusion or expiration of the right of withdrawal

The right of withdrawal only applies to items that have not been customized or modified. The right of withdrawal expires for personalized products.

Loss of value

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning. This means that a loss of value of the goods occurs when the goods are no longer saleable due to wear, washing, or other signs of wear, as well as the removal of the security label, removal of/damage to the original packaging, or missing accessories.

In this case, a compensation for the value of the goods will be deducted from the credit note. This can amount to up to 100% if the goods can no longer be sold. In this case, you can reclaim the purchased items from us.

§4 Retention of title

The goods remain the property of Jasmin Schaal JASAJ-FASHION.COM until they have been paid in full.

§5 Delivery

• 5.1. JASAJ ships goods exclusively to delivery addresses in Germany and to members of the European Union. JASAJ-FASHION.COM bears the transport risk.
• 5.2. The delivery time is up to two working days within Germany and up to five days within the EU from receipt of the order, unless a shorter time is specified during the ordering process.

§6 Prices / Shipping costs

• 6.1. The prices valid at the time of the order apply.
• 6.2. All prices stated in the JASAJ online shop are retail prices and include the statutory VAT of 19%, plus shipping costs.
• 6.3. Any applicable service and shipping costs can be found on the help pages. They are also stated in the order form.

§7 Payment conditions / means of payment

• 7.1 You can pay for your order at JASAJ-FASHION.COM by:
  • PayPal
  • Credit card (Visa and Mastercard)
  • Prepayment by bank transfer (no invoice or installment payment)
• 7.2. Payment via voucher code is made by entering the voucher code in the designated field during the ordering process and then clicking the "Apply code" button.
• 7.3. The discount through a promotional code is also applied by entering the code during the ordering process.
• 7.4. Voucher codes are only valid during the promotional period and cannot be combined with other promotions.

§8 Warranty

Jasmin Schaal JASAJ-FASHION.COM is liable for material and legal defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB). According to Section 438, Paragraph 1, No. 3 of the BGB, the limitation period is two years and begins upon delivery of the goods. The above provisions do not restrict your right of withdrawal in accordance with Section 3.

§10 Choice of law, effectiveness

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

§11 Dispute resolution

Online dispute resolution pursuant to Art. 14 (1) of the ODR Regulation: The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/ . Jasmin Schaal is willing to participate in dispute resolution proceedings before a consumer arbitration board.

§12 Copyrights

The content and structure of the JASAJ online shop, as well as the other websites and social media portals operated by JASAJ, are protected by copyright. All text, images, graphics, audio, and video are subject to copyright, trademark, and other intellectual property laws. Use for purposes other than private use is not permitted without the express prior written consent of JASAJ.
